Whenever a tenant enters a tenancy they are legally bound to pay rent
till the end of the tenancy. This means that they cannot simply take their
things and leave the premises whenever they want to. Under normal
circumstances, if a tenant wants to leave before the end of a tenancy they have
to get a surrender of the property approved from the landlord. The landlord has
all right to refuse this surrender as a result of which the tenant will have to
continue to pay rent till the end of the tenancy. However, if this does not
happen then there are a few steps that landlord and tenants solicitors
may recommend.
Deposit Deductions:-
All tenants are required to submit an amount as deposit at the start of
a tenancy. This deposit may be utilised to cover for damage to the property and
unpaid bills. Interestingly, this deposit is also meant to cover unpaid rent as
well. According to landlord and tenants solicitors,
unpaid rent can be from the time the tenants had been living in the property as
well as the after they have left (before the end of the tenancy). Therefore, if
your tenants have decided to leave the property before the end of the tenancy
and you have not approved the surrender you may deduct the remaining rent from
the deposit.
